INEOS Automotive Canada Limited (“INEOS” or “we”, “our” and similar terms) respects your privacy and is committed to protecting your personal information. This Privacy Notice (this “Notice”) provides Canadian persons with information about how we collect, use, share and otherwise process (collectively, “Process”, “Processing” and similar terms) personal information, as well as information about your privacy rights and choices.

This Notice applies to the Processing of personal information through and using the sites and applications that link to this Notice, such as https://ineosgrenadier.com/en/ca/, which we refer to collectively in this Notice as the “Site”, and also includes all associated content, functionality, and services offered on or through the Site. This Notice is not intended to capture the Processing of employee, applicant, or independent contractor personal information.

The personal information we collect

  • INEOS may collect and Process identity, contact, financial, transaction, technical, profile, usage, marketing and communications, social network, market research and preference data, as described in greater detail at Section 5 below.
  • We also Process aggregated data, such as statistical and demographic data.

How we collect personal information; sources of personal information

  • We may collect personal information when you provide it to us, including when you: fill in our forms; reserve, purchase or express interest in our products; create an account on the Site; subscribe to our services, promotions or publications; request our marketing materials; enter a competition, promotion or survey; register for or attend an event we sponsor or co-sponsor; share content with us through social networks; provide us with feedback; or correspond with us by mail, telephone, email, social media or otherwise.
  • You may provide personal information to our authorized dealers, which they share with us through our dealer and/or customer relationship management system, with your consent. This includes information you provide to dealers when you: create a customer account; express interest in, test drive, purchase or have serviced an INEOS vehicle; apply for a dealer vehicle loan; or attend a dealer-operated event.
  • As you interact with the Site, we may automatically collect data using cookies, server logs, and other similar technologies. We may also receive this data about you if you visit other websites employing our cookies. Please see our Cookies Policy for further details.
  • We may also receive personal information from third parties and public sources, including: analytics, search information, technical, payment, and delivery service providers; and third party social media sites and applications.

How we use your personal information

  • We may use your personal information to: register, communicate with and provide services to you; create, maintain, customize, and secure Site user accounts; process and deliver pre-orders and orders; manage our relationship with you; respond to your questions and requests; coordinate and record warranty service; provide notice of recalls or service actions; coordinate participation in events, competitions, promotions, and surveys; understand Site usage patterns and behavior; provide, support, personalize, and develop our Site, products, and services; evaluate and improve our customer and user experiences, including delivering relevant Site content and advertisements to you; engage in research and development and run technical campaigns; understand our customer and prospect base; engage in promotional or marketing efforts, including sending marketing and promotional communications; and/or administer and protect our business and the Site.
  • We may also use your personal information for such other purposes as are permitted or required by applicable law, including (without limitation) to: prevent or detect transaction or user fraud; maintain the safety, security, and integrity of the Site and our business; respond to lawful requests; evaluate, conduct or conclude business transactions; defend, establish or exercise legal claims; and/or collect on a debt.

When and why we share personal information with others

  • Your personal information may be accessible to members of our customer management team, sales team, after-sales team, legal and finance departments, and such other personnel as may require access to such information for the purposes of performing their duties and responsibilities.
  • We share personal information with other members of the INEOS Group and our service providers, who may use such information for the same purposes described above. Currently our third party service providers include providers of, credit card and payment processing, shipping and delivery management, Site and data management, email distribution, research and analysis, brand, event and product promotion management, professional advisory services, and IT and system administration. INEOS reserves the right to add or change its service providers at any time, in its discretion.
  • We may share personal information with our authorized dealers, as needed for sales and customer service purposes and for other business and commercial purposes consistent with those set forth above. This information may include identifiers, contact information, and sales information.

Data security

  • Although we take steps to safeguard the personal information under our control, "perfect security" does not exist. In particular, we cannot guarantee the security of personal information communicated to us by electronic means, as it is possible that third parties may unlawfully intercept or access such information.

Other key points

  • Neither the Site nor our products and services are targeted to, and we have no interest in collecting personal information from, children under the age of 14. We do not knowingly gather any personal information from children. If you are a parent or legal guardian who believes that your child has provided us with any personal information, please contact our Privacy Team at dataprotection@ineosgrenadier.com.
  • The personal information that we Process is transmitted and stored outside Canada by INEOS and/or our service providers and affiliates. This means that your personal information may be accessible to courts, law enforcement and national security authorities in other countries.
  • If you are located in Quebec, please note that your personal information may be Processed, communicated or stored outside of Quebec. Our Privacy Team is responsible for ensuring our compliance with Quebec’s private sector privacy legislation. This team can be reached at dataprotection@ineosgrenadier.com.
  • You can contact our Privacy Team at dataprotection@ineosgrenadier.com with questions, complaints or to access and/or rectify your personal information, including if you have questions about the collection, use, disclosure or storage of personal information by INEOS and/or its service providers and affiliates outside Canada or to obtain access to written information about our policies and practices with respect to service providers and affiliates outside Canada.

2. PURPOSE AND APPLICABILITY OF THIS NOTICE

INEOS is providing this Notice to inform you about how we Process your personal information. INEOS is part of the INEOS group of companies (the “INEOS Group”), details of which can be found at https://www.ineos.com/. This Notice is not intended to capture how INEOS Group processes personal information of employees, applicants, or independent contractors.

We may provide you with supplemental or additional privacy notices on specific occasions when we collect or otherwise Process personal information about you. On those occasions, it is important that you read this Notice together with all such other notices, so that you can be fully aware of how and why we are Processing your personal information. This Notice supplements all other and additional privacy notices, and is not intended to override any of them (and vice versa).

Neither the Site nor our products and services are targeted to, and we have no interest in collecting personal information from, children under the age of 14. We do not knowingly gather any personal information from children. If you are a parent or legal guardian who believes that your child has provided us with any personal information, please contact us at dataprotection@ineosgrenadier.com.

3. ACCEPTANCE OF THIS NOTICE

Your use of the Site, and all communications between you and us, are subject to this Notice. YOU SHOULD READ THIS ENTIRE NOTICE COMPLETELY AND CAREFULLY BEFORE USING THE SITE AND/OR PROVIDING US WITH ANY INFORMATION, PARTICULARLY PERSONAL INFORMATION. By using the Site in any way, including browsing, creating an account, expressing an interest in any products, and/or using any interactive Site tools, or by otherwise providing us with any personal information, you acknowledge that you have read, understood, and agreed to be bound by this Notice.

4. CHANGES TO THIS NOTICE

Because of changes in technology, practices and legal and regulatory requirements, this Notice may change from time to time. We will post any changes we make to this Notice on this page, and we will provide you notice of such changes and obtain your consent if and when required by applicable law. Any changes will be effective when the updated Notice is posted.

It is your responsibility to check this Notice for updates. You will be able to determine when the Notice was last updated by referring to the “Last Modified” date at the top. By using the Site and/or providing us with any personal information after we post any changes to this Notice, you agree to accept those changes, whether or not you have taken the time to review them.

5. THE PERSONAL INFORMATION WE COLLECT

Personal information means any information about an identifiable individual. Personal information does not include anonymous or anonymized data that cannot be used to identify a specific person.

INEOS may collect, use, store, and transfer different categories of personal information, as follows:

  • Identity Data, which includes first name, last name, title, user name, or similar identifiers, date of birth, age, gender, marital status, driver’s license number, and vehicle identification number.
  • Contact Data, which includes physical address, email address, and telephone numbers.
  • Financial Data, which includes bank account number and payment card details, including credit card number and/or debit card number, and payment history (including records of products and services purchased or considered).
  • Transaction Data, which includes details about payments to and from you, products and services you have purchased from us or our dealers, as well as insurance information, including insurance policy number and details.
  • Technical and Site Usage Data, which includes internet protocol (IP) address and associated geolocation data, browser type and version, login information, time and location settings, browser plug-in types and versions, operating system, platform, referring domains, timestamps (time at which a page was accessed as well as time spent on each page), pages requested and visited, and other similar device data as needed in order to provide our Site and its features.
  • Profile Data, which includes your user name and password, purchases or orders made by you, your interests and preferences, and your feedback and survey responses.
  • Marketing and Communications Data, which includes your contact information and preferences in receiving marketing communications from us and our third-party service providers.
  • Social Network Data, which includes information that you share publicly or that is a part of your public profile on a third party social network, such as user name, location, profile picture, friends lists, photos, videos, posts and stories, and similar media and content.
  • Market Research Data, which includes identifiers, contact information, and survey responses you may voluntarily provide to our third party survey providers from time to time.
  • Preference Data, which includes your vehicle configurations and any accessories or features you select.
  • Phone Call Recordings, which are recorded for training and quality assurance purposes if you contact our customer service team by phone.

We also Process aggregated data, such as statistical or demographic data. Such aggregated data may be derived from personal information, but does not directly or indirectly reveal your identity. For example, we may aggregate Usage Data to calculate the percentage of Site users accessing a specific Site feature. However, if we ever do combine or connect aggregated data with other personal information such that it could directly or indirectly identify you, we will treat the combined data as personal information in accordance with this Notice.

6. HOW WE COLLECT PERSONAL INFORMATION; SOURCES OF PERSONAL INFORMATION

We use different methods to collect personal information from and about you, including as follows:

 

  • Direct Interactions. From time to time, you may provide us with your personal information by filling in forms or by corresponding with us by mail, telephone, email, social media, or otherwise. This includes personal information you provide when you:
    • Reserve or purchase our products or services, or express an interest in our products or services;
    • Create an account on our Site;
    • Subscribe to our services, promotions, or publications;
    • Request that our marketing or other materials be sent to you;
    • Enter a competition, promotion, or survey;
    • Sign up for, register for, pay for, and/or attend any event that we sponsor or co-sponsor;
    • Create and share content with us through third-party social networks, such as by commenting on our social media pages;
    • Provide us with feedback;
    • Contact us through our customer service line (in which case phone calls may be recorded); and
    • Otherwise contact or communicate with us for any reason.
  • Dealer Interactions. You may provide personal information to our authorized dealers that is then shared with us through our dealer and/or customer relationship management system. This includes personal information you provide to dealers:
    • When creating a customer account;
    • In connection with your interest in, purchase of, or servicing of an INEOS vehicle from or at the dealer; and
    • In connection with test drives, dealer vehicle loans, and dealer-operated events.

    Please note that this Notice only applies to personal information that is collected by our dealers and then shared with INEOS, and only applies to INEOS’s Processing of that information. Our dealers may collect, use, and share your personal information in other ways, and we do not and cannot control their collection, use, and sharing of such information. For more information about our dealers’ privacy practices, you should review the privacy notice(s) provided by the applicable dealer, or ask that dealer for more information.

  • Automated Technologies and Interactions. As you interact with our site, we may automatically collect data including Technical and Site Usage Data, and Market Research Data, such as information about the equipment used to access the Site and your browsing actions and patterns. We collect this information using cookies, server logs, and other similar technologies. We may also receive this data about you if you visit other websites employing our cookies.   • Third Party and Publicly Available Sources. We may receive anonymized and aggregated personal information, including Technical and Site Usage Data, and Market Research Data, from third parties and public sources, including:
    • Analytics providers, such as Google Analytics;
    • Search information providers;
    • Providers of technical, payment, delivery, and other services; and
    • Third party social media sites and applications.

7. HOW WE USE YOUR PERSONAL INFORMATION

We use the personal information we collect or receive from third parties for the following business and commercial purposes:

  • To register and verify the information of new customers and prospects;
  • To create, maintain, customize, and secure Site user accounts;
  • To process, fulfill and deliver pre-orders, orders and other sales or commercial transactions, which includes managing and processing deposits, payments, fees, and charges as well as collecting and recovering amounts owed to us, issuing refunds and processing cancellations (if applicable) and providing financing;
  • To issue manufacturing build slots or reservations (if applicable) and to assign a dealer to those customers who place pre-orders or have reservations;
  • To manage our relationship with vehicle owners;
  • To communicate with and provide services to our customers and prospects;
  • To respond to questions and requests, including vehicle configuration change requests;
  • To coordinate and record warranty service;
  • To provide notice of recalls or service actions;
  • To coordinate participation in events, competitions, promotions, and surveys;
  • To understand Site usage patterns and behavior, including counting unique visitors and verifying positioning and quality of ad impressions;
  • To provide, support, personalize, and develop our site, products, and services, including to improve the quality and safety of our vehicles;
  • To evaluate and improve our customer and user experiences, including delivering relevant Site content and advertisements to you;
  • To engage in research and development and run technical campaigns;
  • To understand our customer and prospect base;
  • To engage in promotional or marketing efforts, including to send you communications to keep you informed about INEOS products and services, exclusive events, client programs and other related activities (subject to any consent or opt-out rights required by law); and
  • To administer and protect our business and our Site (including troubleshooting, data analysis, testing, system maintenance and support, debugging to repair and identify errors, and reporting and hosting of data).

In addition, we may use any of the personal information we collect or receive from third parties for the following purposes:

  • To prevent or detect transaction or user fraud, and to help maintain the safety, security, and integrity of our Site and our business;
  • To respond to law enforcement requests and as required by applicable law, court order, warrant, subpoena, summons or governmental regulations;
  • To evaluate, conduct or conclude a merger, divestiture, restructuring, reorganization, dissolution, sale or transfer of some or all of our assets, or other business transaction (each a “Business Transaction”);
  • To defend, establish or exercise legal claims, or to collect on a debt; and
  • For such other purposes as are permitted or required by applicable law.

We will only use your personal information for the purposes disclosed in this Notice or in any supplemental notice provided to you at or prior to our collection of that personal information, or for any reasonably compatible purpose, and subject to limitations and requirements of applicable law. We may also collect and use your personal information for other purposes with your knowledge and consent, express or implied, as permitted by applicable law. If we need to use your personal information for any unrelated purpose, we will notify you and, if required by applicable law to do so, will obtain your consent.

8. WHEN AND WHY WE SHARE PERSONAL INFORMATION WITH OTHERS

We may disclose personal information as described below:

  • Personnel. Your personal information may be accessible to members of our customer management team, sales team, after-sales team, legal and finance departments, and such other personnel as may require access to such information for the purposes of performing their duties and responsibilities.
  • Affiliates. We may share personal information within and among members of the INEOS Group, who may use this information to manage customer and prospect relationships and for other business and commercial purposes consistent with those set forth in Section 7 above.
  • Dealers. We and our authorized dealers may share personal information with one another, for sales and customer service purposes and for other business and commercial purposes consistent with those set forth in Section 7 above. This information may include identifiers, contact information, and sales information. For example, if you place a pre-order for an INEOS vehicle, we may share your vehicle configuration (including any accessories you select), contact information and mailing address with the dealer assigned to you, who may use this information for the purposes of administering the delivery of your vehicle to you. If you provide your contact information on the Site and request to be connected to an INEOS dealer for more information about our products or services, we may disclose such information to our dealers, who may use it to contact you and provide the information you have requested.
  • Service Providers. We may transfer personal information to our service providers and contractors in the ordinary course of our business relationship with those parties. In these circumstances, we take steps to protect your personal information with contractual measures and confidentiality obligations. These service providers may use such information for the purposes described above under Section 7. Depending on your use of the Site, products and services, this may include providers of:

  • credit card and payment processing services, who may have access to customer Financial Data and Transaction Data;
  • shipping and delivery management providers, who may have access to Contact Data (including mailing address) for pre-order holders only, in order to coordinate shipping and delivery of our products;
  • website and/or data management services, who may have access to Technical and Site Usage Data of Site visitors in order to assist us with hosting and operating the site;
  • email distribution services, who may have access to Marketing and Communications Data in order to assist us with email distribution;
  • research and analysis services, who may have access to Market Research Data, in order to provide market research and analysis to us;
  • brand, event and product promotion management services, who may have access to Contact Data of event attendees (e.g., name, address, contact information) and drivers licenses and insurance data collected from event attendees who wish to test drive a vehicle, with attendees’ consent;
  • professional advisory services, including lawyers, bankers, accountants, insurers, and others who provide similar services, who may have access to such personal information as they require to perform these services; and
  • IT and system administration services, who may inadvertently view any personal information we collect in the course of providing maintenance services on our programs or devices.

INEOS reserves the right to add or change service providers at any time, in its sole and absolute discretion, without notice to you, except as may be required by applicable law.

When we transfer personal information to third party service providers and contractors, we enter into agreements with those third parties that describe the purposes for which the personal information may be used and that require the third parties to keep the personal information secure and confidential.

We may also disclose personal information as necessary to respond to law enforcement requests and as required by applicable law, court order, warrant, subpoena, summons or governmental regulations. And, if we evaluate, conduct or conclude a Business Transaction, as described under Section 7 above, we will share information with the applicable counterparty and their designees in connection with that transaction, subject to us taking any steps required by applicable law.

We will not disclose your personal information other than as described in this Notice, or as otherwise permitted or required by applicable law, without providing you notice and, if required by applicable law, obtaining your consent. We do not sell personal information to third parties.

9. COOKIES; INTEREST-BASED ADS

Our Site uses and allows certain third parties to use cookies and similar tracking technologies. We notify you of our use of cookies when you first visit our site. For more information about our use of cookies, see our Cookies Policy.

We use third party advertising companies to deliver and display ads tailored to you based on how you interact with our site, a practice known as interest-based advertising or behavioral advertising. In connection with this practice and as disclosed in our Cookies Policy, we allow these third parties to collect certain information about you when you visit our site, through the placement of cookies or other tracking technologies. 10. INTERNATIONAL TRANSFERS

INEOS and its affiliates and service providers transfer and store the personal information that we collect or receive in countries other than Canada, including in the United Kingdom. We will implement reasonable measures to ensure that transfers of personal information outside of Canada are adequately protected as required by applicable law. However, such personal information may be accessible to courts, law enforcement and national authorities in such other countries.

You may contact our Privacy Team at dataprotection@ineosgrenadier.com if you have questions about the collection, use, disclosure or storage of personal information by our service providers and affiliates outside Canada, or to obtain access to written information about our policies and practices with respect to such service providers and affiliates outside Canada.

11. HOW LONG WE RETAIN PERSONAL INFORMATION

We will only retain your personal information for as long as necessary to fulfil the purpose(s) for which it was collected, including to satisfy any legal, accounting, or reporting requirements.

We retain contact, identity, financial, and transaction data about our customers for six years after they cease being customers for tax purposes.

In some circumstances, we may anonymize your personal information (so that it can no longer be associated with you) and may use such anonymized information for research, analytic, or statistical purposes, in which case we may retain such information indefinitely, as such information will cease to be personal information.

12. DATA SECURITY

We have put in place appropriate physical, technological and administrative security measures to prevent your personal information from being stolen, accidentally lost, altered, or used, disclosed, or accessed in an unauthorized way. In addition, we limit access to your personal information to those employees, agents, service providers, contractors, and other third parties who have a business need to know that information, who are only authorized to process your personal information on our instruction, and are subject to confidentiality obligations.

Although we take steps to safeguard the personal information under our control, "perfect security" does not exist. In particular, we cannot guarantee the security of information communicated to us by electronic means. It is possible that third parties may unlawfully intercept or access such information.

We have put in place procedures to address any suspected or actual personal information breach, and will comply with applicable laws relating to notification of and response to any breaches of security safeguards, confidentiality incidents or other security incidents, as defined by applicable law.

It is your responsibility to keep all information associated with your account with us secure and confidential. We will never ask for any password from you, except as required to create your account (in which case, your password may be stored by your device, but will not be accessible to us). We ask you not to share your account password with anyone.

13. THIRD PARTY SITES AND SOCIAL SHARING FEATURES

Our Site may include links to other websites. We do not control the privacy practices of any third parties, and if you submit personal information to any of those sites, their collection and use of your information is governed by their privacy policies, which differ from ours. We encourage you to carefully read the privacy policy of any website you visit.

Our Site may offer social network and similar sharing features, such as Facebook, Twitter, YouTube, Instagram, and similar buttons, which let you share information related to the Site through your preferred social media platforms. If you permit a connection between our Site and your social network page(s), we (and the social network) may be able to identify you, and associate the information we (and they) receive with information we (and they) already have about you. In addition, depending on how you use those features and your settings with the social network provider(s), the information you share to your social network pages will be available to others, including your friends and/or the public. For more information about how your information may be shared through those social networks once it is provided to them, you should review the privacy policies of those social networks.

14. YOUR RIGHTS REGARDING YOUR PERSONAL INFORMATION

Depending on the Canadian jurisdiction where you are located, you may have certain rights under applicable privacy and data protection legislation. These rights are subject to certain limitations and exceptions under applicable law.

Providing Personal information is Your Choice. You can browse our Site without providing us with any personal information, other than Technical Data and Site Usage Data (which we will not attempt to link with other personal information). However, if you choose to use our Site to engage with us, such as by creating an account, or if you choose to conduct business with or otherwise interact with us, you will be required to provide us with the personal information necessary to facilitate that interaction or transaction. If you do not want to provide us with personal information, we may not be able to conduct business with you or provide you with requested information.

Right to Withdraw Your Consent. You may have the right to withdraw your consent to our continued Processing of your personal information, subject to any permitted restrictions and notice requirements. In some cases, if you withdraw your consent, you may not be able to continue using our Site or avail yourself of certain of our products or services.

Opting Out of Marketing and Promotional Communications. You can ask us to stop sending you marketing and other promotional materials at any time by following the opt-out links in the applicable messages, or by contacting us at any time at dataprotection@ineosgrenadier.com. Please note that when you opt out of marketing messages, we may still need to contact you regarding outstanding orders, product purchases or services, warranty registration, your product or service experience, as required by law, or regarding legal matters. However, we will not send you marketing communications after you have opted out of receiving them.

Right to Access Your Personal information. You may have the right to access your personal information, subject to certain exceptions and limitations pursuant to applicable law. This right may include: the right to be informed of whether or not we hold personal information about you; the right to be informed of the existence, use, and disclosure of your personal information; the right to review and/or obtain a copy of your personal information; the right to obtain an account of the use that has been made or is being made of your personal information and the third parties to which it has been disclosed; and/or the right to receive a list of organizations to which we have, or may have, disclosed information about you.

Right to Correct Your Personal information. If you believe any personal information we have about you is incomplete or incorrect, you may have the right to challenge the accuracy and completeness of your personal information and have it amended or rectified as appropriate. Depending on the purposes of the Processing, you may have the right to correct, delete or add information. In addition, if you have an account on our site, you may be able to update certain of your account details directly through the Site.

Opting Out of Targeted Advertising. As noted above, we use third party advertising companies to deliver and display ads tailored to you based on how you interact with our site, a practice known as interest-based advertising or behavioral advertising. You can opt out of having your personal information used for this purpose by setting your cookies preferences on our Cookies Dashboard, accessible within our Cookies Policy.

Limitations. Each of the rights set forth above may be subject to certain limitations as set forth in applicable law. Your rights may depend on the jurisdiction where you are located, as different jurisdictions have adopted privacy laws that provide for specific rights and remedies applicable solely to residents of such jurisdictions.

Complaints. You may have the right to address a challenge concerning our compliance with applicable privacy and data protection legislation to our Privacy Team.
