References in this Indemnity Form to “I”, “you”, “my” and “your” means the driver or passenger or guest as set out above.

INEOS Automotive Limited and its affiliate companies (together “INEOS”) are pleased to offer you the opportunity to take part in this Event/Use. As a condition of allowing you to participate, we require you to read and agree to this form prior to or upon arrival to the Event/Use. You will not be allowed to drive or ride in the vehicle or participate in the Event/Use unless you have completed and agreed to the form.

In consideration of me being permitted to participate, I hereby confirm that:

I am 21 years of age or older. I understand that I am at all times responsible for any persons attending the Event/Use with me who are under 18 years of age and that (a) such persons will not be permitted to drive a vehicle and (b) permission for them to ride in a vehicle is at the discretion of INEOS and/or the event organisers.
I am physically and mentally fit and competent to take part in the Event/Use and am not suffering from any medical condition which could adversely affect my participation in the Event/Use including but not limited to epilepsy, heart conditions, uncorrected hearing or vision impairment.
I am not under the influence of alcohol or drugs and will not participate in the Event/Use under such influence.
I hold a full driving licence which is valid for driving a motor vehicle in the driving activities in which I am participating at the Event/Use and in the country in which the Event/Use is taking place. I have held this licence for a minimum of 2 years, have not had any disqualifications in the past 12 months and have no more than 6 penalty points (Drivers only).
When requested by INEOS or the event management company, I will provide documents (ID, driving licences, etc) and any authorisations necessary for participation in the Event/Use.
I am able to understand instructions given to me by INEOS and/or the Event/Use organisers to a level that enables me to participate safely in the Event/Use.
I understand the nature of the Event/Use, and the potential risk of serious personal injuries, death or damage to property associated and I accept that I am solely responsible for any decision to drive or to be a passenger in any such vehicle at any time throughout the duration of the Event/Use or participate in the Event/Use and that I do so freely at my own will and solely at my own unreserved risk.
Subject to clause 14 below, I assume all risks of injury to myself, my death and loss of or damage to my property, that may be sustained by me driving or being a passenger in any vehicle during the Event/Use or participating in the Event/Use.
I understand that INEOS is the organiser of the Event/Use but is not in charge of, and consequently does not assume any risk or responsibility deriving from the use of the facilities at the event location and/or the condition of any driving course and/or the adoption of safety measures and emergency measures in case of accident and/or the driving course management during the Event/Use.
Subject to clause 14 below, I release, hold harmless and indemnify INEOS and its parent, associated and/or affiliated companies and their employees, contractors and directors from and against all claims, demands, actions, liabilities, costs and expenses in respect of any injury I may suffer, my death and/or any and all loss or damage to property arising out of or in connection with my attendance at and/or participation in the Event/Use.
I understand that the Event/Use as a whole and/or individual elements of the Event/Use cannot be guaranteed and is subject to the weather and/or facility schedule.
I will comply with any requests made by, and will abide by all rules, terms and conditions, safety information, procedures and instructions provided to me by INEOS, its representatives and any representatives of the event management company and/or the facility owner. Failure to comply with these instructions may result in my immediate exclusion from the Event/Use or parts of the Event/Use.
I will adapt my driving to the weather conditions, visibility and/or surface conditions while using the venue and will adopt the safety measures and use safety equipment (and make passengers use such safety equipment) as may be prescribed by INEOS or the event organiser.
Nothing in this form seeks to limit or exclude any liability of INEOS arising out of fraud, death or personal injury caused by INEOS’ negligence and/or any other matter for which it would be illegal for INEOS to limit, exclude or attempt to limit or exclude its liability.
The terms of this Indemnity shall be binding upon me, my heirs, next of kin, beneficiaries, executors, administrators and other personal representatives.
I am aware that my personal data will be processed by INEOS, including by electronic means, for the purpose of organising the Event/Use and to allow my participation and in accordance with the INEOS’ privacy notice found at https://ineosgrenadier.com/en/gb/privacy.
The terms of this Indemnity shall be governed by and construed in accordance with the laws of England and Wales, and I irrevocably submit to the non-exclusive jurisdiction of the courts of England and Wales in the event of any dispute arising under or in connection with this Indemnity.

I HAVE READ THIS INDEMNITY, FULLY UNDERSTAND AND AGREE TO ITS TERMS.

INEOS Automotive Limited and its affiliates would like your permission to process the following categories of your personal data: title, name, postcode, telephone number, email address (“contact information”) and information about the test-driving experience; for the following purposes:

sending future INEOS Automotive event information; and
sending marketing information about their products and services.

Such consent to the processing of your contact information by INEOS is voluntary and may be withdrawn at any time without giving reasons by sending an email or letter to:

In consenting, I acknowledge that my data will be stored for up to 2 years by INEOS, unless I withdraw my consent earlier. Furthermore, I have the right to request access to the personal data INEOS hold concerning me, as well as to correction or deletion and restriction of processing and a right to object to processing and data transfer and a right to lodge a complaint with my local data protection authority.
